Terms of Service

Written to be readable. The short version: bring properly consented leads, follow the law, pay your bill, and we'll give you a reliable platform with the guardrails on.

These Terms of Service ("Terms") govern access to and use of the lead2inbound platform, websites, and APIs (the "Service") provided by lead2inbound ("we," "us"). By creating an account or using the Service you ("Customer," "you") agree to these Terms on behalf of yourself and the organization you represent.

1. The Service

lead2inbound is a software platform that lets you import sales leads, initiate AI-assisted outbound telephone calls to those leads through third-party voice and telephony providers using your own provider accounts, warm-transfer qualified calls to destinations you configure, and track the results. We provide software orchestration only; we are not a telephone carrier, a lead seller, a call center, or a law firm.

2. Your compliance responsibilities

This section matters more than any other. Outbound calling — especially with an artificial or prerecorded voice, which is how regulators treat AI-generated voice — is regulated under the TCPA, the Telemarketing Sales Rule, and state laws.

We may suspend campaigns or accounts that we reasonably believe are generating unlawful calls. We build compliance tooling because we want you protected — but the legal responsibility for your calling program is yours.

4. Third-party providers (bring-your-own keys)

The Service connects to AI voice, telephony, DNC, and routing providers using credentials you supply from your own accounts with those providers. Your relationship with each provider is governed by their terms and prices; their usage fees are billed by them to you directly. We store your credentials encrypted and use them only to perform the actions you configure. We are not responsible for third-party provider outages, pricing changes, or account actions.

You will not: reverse-engineer or resell the Service without a written agreement; probe or breach its security; use it to violate any law; import data you have no right to use; or interfere with other tenants. API access is subject to documented rate limits.

7. Availability and support

We operate the Service on enterprise cloud infrastructure and target high availability, but the Service is provided without a guaranteed uptime SLA at this time. We may modify features with reasonable notice of material reductions.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPLIANCE FEATURES ARE TOOLS, NOT LEGAL GUARANTEES: NO SOFTWARE CAN MAKE AN UNLAWFUL CALLING PROGRAM LAWFUL. NOTHING IN THE SERVICE OR ITS DOCUMENTATION IS LEGAL ADVICE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR INDEMNITY OBLIGATIONS OR YOUR BREACH OF SECTION 2.

10. Termination

You may cancel at any time in the billing settings. We may suspend or terminate for material breach (including compliance violations), non-payment, or legal risk. Upon termination we will make Customer Data available for export for 30 days, after which it is deleted from production systems on our standard schedule.

11. General

These Terms are the entire agreement regarding the Service and supersede prior discussions. We may update these Terms; material changes will be notified by email or in-app at least 14 days before taking effect, and continued use constitutes acceptance. If any provision is unenforceable, the remainder stands. These Terms are governed by the laws of the United States and the state in which lead2inbound is organized, without regard to conflict-of-law rules.
